HUNTSVILLE CURLING CLUB

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

(to be executed by Participants over the Age of Majority)

WARNING! Please read carefully. This is a binding legal agreement. Clarify any questions or concerns before signing.

As a participant in the sport of curling and the activities, programs, classes, services provided and events sponsored or organized by Curling Canada, and the Ontario Curling Association, and the Huntsville Curling Club, including but not limited to games, tournaments, practices, training, dry land training, use of strength training and fitness conditioning equipment, machines and facilities, nutritional and dietary programs, orientation or instructional sessions or lessons, aerobic and anaerobic conditioning programs (collectively the “Activities”), the undersigned acknowledges and agrees to the terms outlined in this agreement.

Disclaimer

  1. Curling Canada, and the Ontario Curling Association, and the Huntsville Curling Club and their respective Directors, Officers, committee members, members, employees, coaches, volunteers, officials, participants, agents, sponsors, owners/operators of the facilities in which the Activities take place, and representatives (collectively the “Organization”) are not responsible for any injury, personal injury, damage, property damage, expense, loss of income or loss of any kind suffered by a Participant during, or as a result of, the Activities, caused in any manner whatsoever including, but not limited to, the negligence of the Organization.

Description and Acknowledgement of Risks

  1. I understand and acknowledge that:
  2. The Activities have foreseeable and unforeseeable inherent risks, hazards and dangers that no amount of care, caution or expertise can eliminate, including without limitation, the potential for serious bodily injury, permanent disability, paralysis and loss of life. The sport of curling is played on a sheet of ice, which is slippery, hard, and dangerous;
  3. A pertinent risk to participating in the sport of curling is the risk of suffering serious head injury should I fall, trip, or stumble onto the ground or ice. It is highly recommended that I wear a helmet and grippers on both feet when participating in the sport of curling;
  4. The Organization has a difficult task to ensure safety and it is not infallible. The Organization may be unaware of my fitness or abilities, may misjudge weather or environmental conditions, may give incomplete warnings or instructions, and the equipment being used might malfunction; and COVID-19;
  5. The coronavirus disease COVID-19, has been declared a worldwide pandemic by the World Health
  6. Organization and COVID-19 is extremely contagious. The Organization has put in place preventative measures to reduce the spread of COVID-19; however, the Organization cannot guarantee that I will not become infected with COVID-19. Further, participating in the Activities could increase my risk of contracting COVID-19.
  7. I am participating voluntarily in the Activities. In consideration of my participation, I hereby acknowledge that I am aware of the risks, dangers and hazards associated with or related to the Activities. The risks, dangers and hazards include, but are not limited to:
    1. Health: executing strenuous and demanding physical techniques, physical exertion, overexertion, stretching, dehydration, fatigue, cardiovascular workouts, rapid movements and stops, lack of fitness or conditioning, traumatic injury, bacterial infections, rashes, and the transmission of communicable diseases, including viruses of all kinds, COVID-19, bacteria, parasites or other organisms or any mutation thereof;
    2. Premises: defective, dangerous or unsafe condition of the facilities; falls; collisions with objects, walls, equipment or persons; dangerous, unsafe, or irregular conditions on floors, ice, or other surfaces, extreme weather conditions; travel to and from premises;
    3. Use of Equipment: mechanical failure of the equipment; negligent design or manufacture of the equipment; the provision of or the failure by the Organization to provide any warnings, directions, instructions or guidance as to the use of the equipment; failure to use or operate the equipment within my own ability;
    4. Contact: contact with brooms, brushes or curling stones, other equipment, vehicles, or other persons, and may lead to serious bodily injury, including but not limited to concussions and/or other brain injury, or serious spinal injury;
    5. Advice: negligent advice regarding the Activities;
    6. Ability: Failing to act safely or within my own ability or within designated areas;
    7. Sport: the game of curling and its inherent risks, including but not limited to, running, sliding or slipping on the ice surface, delivering the curling stone, skipping or sweeping, stepping onto the ice surface from the walkway or onto the walkway from the ice surface, or stepping over dividers that divide one sheet of ice from the next;
    8. Cyber: privacy breaches, hacking, technology malfunction or damage;
    9. Conduct: My conduct and conduct of other persons including any physical altercation between participants;
    10. Travel: Travel to and from the Activities;
    11. Negligence: My negligence and negligence of other persons, including negligence on the part of the Organization, may increase the risk of damage, loss, personal injury or death. I understand that the Organization may fail to safeguard or protect me from the risks, dangers and hazards of curling programs, some of which are referred to above.

Terms

  1. In consideration of the Organization allowing me to participate in the Activities, I agree:
    1. That when I practice, I am responsible for my surroundings and the location and equipment that I select;
    2. That my mental and physical condition is appropriate to participate in the Activities and I assume all risks related to my mental and physical condition;
    3. To comply with the rules and regulations for participation in the Activities;
    4. To comply with the rules of the facility or equipment;
    5. That if I observe an unusual significant hazard or risk, I will remove myself from participation and bring my observations to a representative of the Organization immediately;
    6. The risks associated with the Activities are increased when impaired and I will not to participate if impaired in any way;
    7. That it is my sole responsibility to assess whether any Activities are too difficult for me. By commencing an Activity, I acknowledge and accept the suitability and conditions of the Activity;
    8. That I am responsible for my choice of safety or protective equipment and the secure fi􀆫ng of that equipment.
    9. Covid-19: that COVID-19 is contagious in nature and I may be exposed to, or infected by, COVID-19 and such exposure may result in personal injury, illness, permanent disability, or death.

Release of Liability and Disclaimer

  1. In consideration of the Organization allowing me to participate, I agree:
    1. That the sole responsibility for my safety remains with me;
    2. To ASSUME all risks arising out of, associated with or related to my participation;
    3. That I am not relying on any oral or written statements made by the Organization or its agents, whether in a brochure or advertisement or in individual conversations, to agree to participate in the Activities;
    4. To WAIVE any and all claims that I may have now or in the future against the Organization;
    5. To freely ACCEPT AND FULLY ASSUME all such risks and possibility of personal injury, death, property damage, expense and related loss, including loss of income, resulting from my participation in the Activities;
    6. To FOREVER RELEASE and INDEMNIFY the Organization from any and all liability for any and all claims, demands, actions, damages (including direct, indirect, special and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the “Claims”) which I have or may have in the future, that might arise out of, result from, or relate to my participation in the Activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the Organization;
    7. To FOREVER RELEASE AND INDEMNIFY the Organization from any action related to my becoming exposed to or infected by COVID-19 as a result of, or from, any action, omission or negligence of myself or others, including but not limited to the Organization;
    8. That the Organization is not responsible or liable for any damage to my vehicle, property, or equipment that may occur as a result of the Activities;
    9. That negligence includes failure on the part of the Organization to take reasonable steps to safeguard or protect me from the risks, dangers and hazards associated with the Activities; and
    10. This release, waiver and indemnity is intended to be as broad and inclusive as is permitted by law of the Province of Ontario and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

CONSENT FOR USE OF PERSONAL INFORMATION USE

  1. The Participant gives permission to the Organization to photograph and/or record the Participant’s image and/or voice and to use this material to promote the Organization, the results of a competition and/or the Organization’s Activities through social media, newsletters, websites, television, film, radio, print and/or displays. The Participant waives any claim to remuneration for the use of audio/visual materials used for these purposes. Furthermore, The Participant gives consent to collect and use personal information about the participant as described in The Ontario Curling Association’s policies for privacy.

Jurisdiction

  1. I agree that in the event that I file a lawsuit against the Organization, I will do so solely in the Province of Ontario and further agree that the substantive law of the Province of Ontario will apply without regard to conflict of law rules.

Concussion Awareness Declaration

  1. I/WE declare that we have read and understood a Concussion Awareness Resource for the appropriate age group (Age 10 & Under, Age 11-14, or Age 15 & Older) as required by Ontario Law for anyone under the age of 26 to be able to participate in organized sports. Acknowledgement

  1. I acknowledge that I have read and understand this agreement, that I have executed this agreement voluntarily, and that this agreement is to be binding upon myself, my heirs, spouse, children, parents, guardians, next of kin, executors, administrators and legal or personal representatives. I further acknowledge by signing this agreement I have waived my right to maintain a lawsuit against the Organization on the basis of any claims from which I have released herein.

March 31, 2026 Update

A Heartfelt Thank You to the HCC Community!

We are thrilled to share that we’ve hit our fundraising milestone! This success belongs to every one of you. From league donations, bar tips, and bonspiel raffles to the simple act of wearing an Access125 pin, your collective support has moved us closer to a more accessible club for everyone.

Reaching this goal was a true team effort. We are deeply moved by the stewardship contributions of over 75 members and 10 community partners who stepped up to make this possible. Every donation—no matter the size—has brought us closer to a facility that serves all of our members equally.

While we celebrate today, the work continues. To complete our final renovations by September 2026, we’re extending our efforts into one last "home stretch" year.

In the 2025/26 season the Huntsville Curling Club will celebrate its 125th anniversary. Over the next few seasons, the Club is embarking on the final stages of renovation plans to create a fully accessible facility and to set the foundation for the next 125 years! Given the age of our core building infrastructure, substantial changes are required to make HCC fully accessible. As such, $500,000 in additional renovations at the Club have been forecasted, including:

  • an accessible club entrance, 
  • a lift to allow participants to move to each level of the club, 
  • accessible washroom and change room facilities.

HCC has introduced a capital campaign called Access125 with a goal of raising over $125K. All funds raised through Access125 will go directly toward the installation of the new accessible front entrance and the elevator lift. Access125 runs from Sept. 2023 to mid-2026 and consists of a number of FUNraising events (such as Saddle Up Huntsville!), Stewardship and Naming Rights. 

Stewardship: One aspect of Access125 is a Stewardship campaign. The HCC is working with curlers, past & present, as well as the community, service clubs, and sponsors to support Access125 through a 3 year pledge. We have set up a curling house “motif” to align potential donation levels with a curling term, as well as how we plan to acknowledge and recognize Donor support.

The “Olde” Club

Before Huntsville accepted it’s official status moving from a village to a town in 1901, before there were vehicles in Huntsville, when transportation was either by steamships or horse and buggy, a public meeting was called at the Huntsville CourtHouse to officially found The Huntsville Curling Club on December 3, 1900.

The founding fathers of the curling club were the founding fathers of Huntsville; people like George Hutcheson, Reeve of Huntsville and builder of Trinity Church in 1897, C.O. Shaw, owner of the Tannery, Charles Waterhouse, owner of Deerhurst Resort 1896, E.S. May, our first VP and third Mayor of Huntsville, Captain George Marsh, owner of the Steamship Company, and William Blackburn, owner of the Marina. 

The “Olde” club was located directly behind the current club at the corner of Center Streets and Mary Street. It was a single sheet wooden structure, built by William Blackburn on land owned by Henry May. C.O. Shaw was the first club’s Patron. This building was busy all four seasons as there were many offseason political meetings, recitals, band practices and entertainment events happening. The curling was at times very competitive, especially with two skips in particular, Mr Cook and Mr McLaughlin, who always drew spectators and speculation as to who would win the weekly match. 

Sadly, the curling building collapsed under snow load in 1910. 

The Arena Years

During the 1920’s, efforts with the town to build a curling club under the same roof as the proposed arena were thwarted by the Great Depression. The arena was built in 1931, and the curling club got cut. Nonetheless, in the 1930’s, significant fundraising activities began to buy property and build a curling rink. 

In 1940, as a result of the arena being underutilized due to WW2, the old Memorial Arena became the home of the Huntsville Curling Club from 1940 to 1947. During this time, the club joined the Ontario Curling Association in 1942 and has been a continuous member ever since. 

The Department of Highways Building 

By 1946, the war was over and the soldiers had returned. There was immense pressure to relocate the curling club, but no town financial support. Since fundraising had begun in the 1930’s and continued through the arena years, the club was in a position to purchase the decommissioned Department of Northern Development building located at 6 Lansdowne, now 6 Veterans Way, our club’s location since 1947. 

It took only one month for Don Lough to excavate the floor and build a rolled gravel and sand base. Pat Brothers then created three sheets of natural curling ice. Meanwhile, a group of members converted the offices into a clubhouse. The curling club opened its doors to the Huntsville community on January 1, 1948. It was in this building that Pat Brothers scored the clubs first Eight-Ender in 1948. It was in this building where Moss Leverton founded the Huntsville Ladies Curling Club in 1949. 

Sadly, after only three years, the curling club was destroyed by fire on February 8, 1951. Ray Morris, our club's treasurer at the time and future president, ran into the burning building and came out with four of our most historic trophies, two under each arm. Everything else was destroyed by the fire. 

The Rebuilt Huntsville Curling Club Building

On January 10, 1952, the Huntsville Curling Club, once again, opened its doors to the Huntsville community. It had been decided to build a “purpose built”, a building for a single purpose which was curling, a four sheet curling rink with a two level clubhouse with large viewing windows from each sheet to the clubroom. The four sheets of ice were covered by an impressive peaked wooden structure. With the exception of the rink roof, which collapsed in 1972, once again due to snow load, and was replaced with a flat structural steel roof and walls, this has been our current curling club building since then.

Members of Honor

All of the club's members, from 1900 to today have been incredibly dedicated volunteers. They are the reason the Huntsville Curling Club exists. There have also been many extraordinary team and individual accomplishments by our members.

Twice, the Huntsville Curling Club’s Ladies' teams have gone to the Southern Ontario Ladies Curling Championships. 

  • Vera Armstong’s rink of Marjory Ireland, Mardi McDonald and Murdo Cameron defeated Oshawa in the final 17-14 to win the 1960 Southern Ontario Women’s Championships in Kitchener.
  • In 1982, Yvonne Cox’s rink of Gail Stevens, Ruth Gilbert and Carol Sullivan won the district in Parry Sound, then the regionals in Beaverton before qualifying for the 1982 Southern Ontario Ladies Championships in St Catherines. 

In 1989, Nicole Dutkiewicz fundraised to buy a set of newly created rocks called “Kids Can Curl'' rocks, just invented by the Bayview Curling Club in Toronto. 

Instead of having kids learn the game of curling, Nicole developed a curriculum of lessons to teach children how to curl one skill at a time. Because the rocks were “littler” than the adult rocks, her program was called “Little Rocks”. This program was almost immediately adopted by clubs across Ontario. Five years later, Nicole was awarded the Ontario Sports Achievement Honor, by then Premier Bob Rae, for her achievements in the sport of youth curling in Ontario.

In 1998, Rusty Drew invented the “Extender” at the Huntsville Curling Club. The Extender is an accessibility aid - it is a stick with a plastic clip that allows a person to deliver a rock without crouching down in the hack. Rusty tried the extender on curlers standing up and a person in a wheelchair - both delivered the rock into the house with no difference from the curler in the hack. The first ever rock delivered by a person in a wheelchair was during this time here in Huntsville in 1998. 

Rusty sought approval from Curling Canada for use of the extender. Within two months of his application, Curling Canada approved the extender for every level of curling except competitive, paving the way for Rusty to patent the design. Well known Muskoka author Susan Pryke, wrote an article in CARP Fifty Plus Magazine about Rusty’s Extender causing news of the extender to spread like wildfire. The first ever World Wheelchair Championships were held in Geneva Switzerland in 2002. The Extender was the delivery aid they endorsed. 

Rusty was inducted into the Canadian Sports Hall of Fame, in the category of Innovations Curling. The Canadian Sports Hall of Fame also credits Rusty with the Creation of the Sport of Wheelchair Curling. 

“If you want to make friends, join the Huntsville Curling Club”. This phrase was said by Wendy Howard, wife of Canada’s greatest curler, Russ Howard. Both Russ and Wendy were members and avid volunteers of the Huntsville Curling in the late 1970’s and early 1980’s. 




Love It! or List It!

Update April 11, 2019

The Planning Committee of the Board of Directors are completing a Love It Phased plan with the following priorities:

  1. Minimize the risk to ongoing curling,
  2. Enhance energy efficiency,
  3. Provide an accessible facility,
  4. Upgrades to enhance enjoyment of the club

There will be external communications to the local media to provide them with an update that HCC plans to move forward with renovations to our existing club.  It is an important message to our sponsors and partners that we will still need their ongoing support.

We are moving ahead with Phase 1 renovations.  See below for highlights and join us at the AGM on June 11th for more details!

We are proceeding this year with the replacement of all roofing and lights in the curling shed, the two highest priority repairs necessary to ensure the continuity of curling. We will be drawing on the HCC capital funds to cover the costs which have been allocated for repairs of this nature.

The Huntsville Curling Club – The Next Generation (Media Release)

Over the past many years the Huntsville Curling Club (HCC) has diligently pursued the opportunity to partner with the Town of Huntsville (TOH) in developing a new multi-purpose recreational facility including a new curling rink. The TOH supports the multi-purpose facility vision but, due to other priorities, is not able to move forward with funding this initiative at this time.

The HCC has been in existence for 120 years and the current facilities have reached a critical state where a significant investment is required to ensure continuity of the curling programs and services provided to the community.

As a result, the HCC is excited to now move forward with a multi-year renovation to the existing facility to ensure long term safe and accessible curling for the Huntsville and area communities. An investment of approximately $1M is required to modernize the facility including addressing critical issues such as the roof, a requirement to make the club fully accessible and to improve its energy efficiency.

We are sincerely grateful to our sponsors and the local area businesses that support our annual fundraising activities like the Pancake Breakfast and the Rocks to Ridges Golf Tournament. Our sponsors also showed their phenomenal support as we hosted the Ontario Men’s Tankard in 2018.

HCC will need the continuing support of the TOH, the community, as well as local businesses as we embark upon our journey to make our club safe, accessible and energy efficient; a modern place where we can continue to grow our sense of community. Our goal is that HCC continues to be a center for Huntsville and area residents to participate in a sport that promotes lifelong healthy active living.

About The Huntsville Curling Club

The Huntsville Curling Club (HCC) is a community based organization that provides programs for all segments of the population, from youth to seniors, to promote active healthy living in our community. Over 1000 Huntsville and surrounding area residents use the HCC regularly and we continue to pursue growth strategies to expand community use. We have an extensive school program for children aged 6 – 18 and we offer social and development leagues and a Learn to Curl program for new curlers. Each year, the HCC hosts Ontario Curling Association events, such as an Under 21 Mixed Qualifier and a Senior Provincial Qualifier, bringing players and their families into the Huntsville area.

HCC is a volunteer run organization with a small number of employees. The leadership of the HCC, the leagues, youth programs and the general operations of the club are all run by our highly committed volunteers. HCC is self-funded through membership dues and fund-raising activities. The HCC does not receive any Federal/Provincial or Municipal funding to support its ongoing operating costs.

Love It! or List It!

Update February 28, 2019

In December, members of the Planning Committee and Board of Directors of the Huntsville Curling Club presented two options for the future of curling in Huntsville. The “Love It” option was to stay and renovate the existing facility and the “List it” option was defined as moving to a new Multi-use facility with significant financial support from the Town of Huntsville (TOH).

The TOH has now responded to the request from the Huntsville Curling Club for financial support for a new facility. The TOH has offered land, services and parking for a new site however, unfortunately, they are not able to support the additional $3M financial request for support.

Without full financial support from the TOH, the “List it” option is not viable for the Huntsville Curling Club. The article published recently in the Doppler covered the TOH council meeting where the Huntsville Curling Club request was discussed. Here is the link if you have not seen the article.

With the “List it” option being no longer viable for the Huntsville Curling Club, we will be pursuing the “Love it” option, which will entail renovating and enhancing the current facility on Veterans Way to support the future of curling in Huntsville.

The Planning Committee under the direction of the Board of Directors, are now starting the work to refine the scope, timing and funding for the renovation of the existing facility. It is expected a phased approach will be taken to complete the renovations that will take several years to complete.

We intend on providing you with a more detailed update at the Annual General Meeting in June to outline the scope, timing and funding of the renovation project.  In the meantime if you have any questions, please feel free to contact any member of the Planning Committee which includes:

Love It! or List It!

December 2,3, 2018

The Planning Committee, a sub-committee of the HCC Board of Directors, has been working towards options for the longterm sustainability of curling in Huntsville.  2 options have been explored extensively.  Love It! - remain in the current location and renovate the existing facility.  List It! - build and move to a new multi-purpose facility at McCulley Robertson field in partnership with the town of Huntsville. The Westridge Curling Club relies on the support of the community to successfully run our club and events. We promote community involvement, fitness and wellness through curling and have many opportunities for participation. We have weekly curling leagues for everyone, Seniors, Men, Ladies and Juniors as well as several bonspiels throughout the year.


Our bonspiels bring people in from out of town who shop in our stores, eat in our restaurants, stay in our hotels and fill up with fuel before they leave. We want to support businesses who support curling.

2025/26 Curling Season

The fee plans available give you the flexibility to fit curling into your schedule.
Memberships are available on an Annual or per Session basis.
Bonspiels and special events are not included and do require an entry fee.

The curling season consists of 3 seven week Sessions defined as:

  • Fall Session:  Tuesday October 14 - Monday December 1, 2025

  • Winter Session:  Tuesday December 2, 2025 - Sunday February 1, 2026  (Christmas break Dec 23 - Jan 3, 2026)

  • Spring Session:  Monday February 2 - Sunday March 29, 2026

The season will close with an Open Steak Spiel (vegetarians accommodated as well) following the last week of curling

CURLING CANADA - INFORMED CONSENT AND ASSUMPTION OF RISK AGREEMENT
For Participants Under the Age of Majority

 

 Parent or Guardian, please read carefully. By signing this document, you will assume certain risks and responsibilities.

 

1. This is a binding legal document. Clarify any questions or concerns before signing.

2. As a Participant in the sport of curling and the activities, programs, classes, services provided and events sponsored or organized by

Curling Canada,         CurlON,        Huntsville Curling Club

(collectively the “Organization”), including but not limited to: games, tournaments, practices, training, personal training, dry land training, use of strength training and fitness conditioning equipment, machines and facilities, nutritional and dietary programs, orientational or instructional sessions or lessons, aerobic and anaerobic conditioning programs (collectively the “Activities”), the undersigned being the Participant and Participant’s Parent/Guardian (collectively the “Parties”) acknowledges and agrees to the following terms outlined in this agreement:

3. I am the Parent/Guardian of the Participant and have full legal responsibility for the decisions of the Participant.

 

Description and Acknowledgement of Risks

4. The Parties understand and acknowledge that:

  1. The Activities have foreseeable and unforeseeable inherent risks, hazards and dangers that no amount of care, caution or expertise can eliminate, including without limitation, the potential for serious bodily injury, permanent disability, paralysis and loss of life. The sport of curling is played on a sheet of ice, which is slippery, hard, and dangerous;
  2. A pertinent risk to participating in the sport of curling is the risk of suffering serious head injury should the Participant fall, trip, or stumble onto the ground or ice. It is highly recommended that the Participant wear a helmet at all times when participating in the sport of curling;
  3. The Organization has a difficult task to ensure safety and it is not infallible. The Organization may be unaware of the Participant’s fitness or abilities, may misjudge weather or environmental conditions, may give incomplete warnings or instructions, and the equipment being used might malfunction;
  4. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization and COVID-19 is extremely contagious. The Organization has put in place preventative measures to reduce the spread of COVID-19; however, the Organization cannot guarantee that the Participant will not become infected with COVID-19. Further, participating in the Activities could increase the Participant’s risk of contracting COVID-19.

5. The Participant is participating voluntarily in the Activities. In consideration of that participation, the Parties hereby acknowledge that they are aware of the risks, dangers and hazards and may be exposed to such risks, dangers and hazards. The risks, dangers and hazards include, but are not limited to:

  1. Health: executing strenuous and demanding physical techniques, physical exertion, overexertion, stretching, dehydration, fatigue, cardiovascular workouts, rapid movements and stops, lack of fitness or conditioning, traumatic injury, bacterial infections, rashes, and the transmission of communicable diseases, including viruses of all kinds, COVID-19, bacteria, parasites or other organisms or any mutation thereof.
  2. Premises: defective, dangerous or unsafe condition of the facilities; falls; collisions with objects, walls, equipment or persons; dangerous, unsafe, or irregular conditions on floors, ice, or other surfaces, extreme weather conditions; travel to and from premises.
  3. Use of Equipment: mechanical failure of the equipment; negligent design or manufacture of the equipment; the provision of or the failure by the Organization to provide any warnings, directions, instructions or guidance as to the use of the equipment; failure to use or operate the equipment within my own ability.
  4. Contact: contact with brooms, brushes or curling stones, other equipment, vehicles, or other persons, and may lead to serious bodily injury, including but not limited to concussions and/or other brain injury, or serious spinal injury.
  5. Advice: negligent advice regarding the Activities.
  6. Ability: Failing to act safely or within my own ability or within designated areas.
  7. Sport: the game of curling and its inherent risks, including but not limited to, running, sliding or slipping on the ice surface, delivering the curling stone, skipping or sweeping, stepping onto the ice surface from the walkway or onto the walkway from the ice surface, or stepping over dividers that divide one sheet of ice from the next.
  8. Cyber: privacy breaches, hacking, technology malfunction or damage.
  9. Conduct: My conduct and conduct of other persons including any physical altercation between participants.
  10. Travel: Travel to and from the Activities.

Terms

6. In consideration of the Organization allowing the Participant to participate in the Activities, the Parties agree:

  1. That when the Participant practices or trains in their own space, the Parties are responsible for the Participant’s surroundings and the location and equipment that is selected for the Participant;
  2. That the Participant’s mental and physical condition is appropriate to participate in the Activities and the Parties assume all risks related to the Participant’s mental and physical condition;
  3. To comply with the rules and regulations for participation in the Activities;
  4. To comply with the rules of the facility or equipment;
  5. That if the Participant observes an unusual significant hazard or risk, the Participant will remove themselves from participation and bring their observations to a representative of the Organization immediately;
  6. The risks associated with the Activities are increased when the Participant is impaired, and the Participant will not participate if impaired in any way;
  7. That it is their sole responsibility to assess whether any Activities are too difficult for the Participant. By the Participant commencing an Activity, they acknowledge and accept the suitability and conditions of the Activity;
  8. That COVID-19 is contagious in nature and the Participant may be exposed to, or infected by, COVID-19 and such exposure may result in personal injury, illness, permanent disability, or death; and,
  9. That they are responsible for the choice of the Participant’s safety or protective equipment and the secure fitting of that equipment.

7. In consideration of the Organization allowing the Participant to participate, the Parties agree:

  1. That the Parties are not relying on any oral or written statements made by the Organization or their agents, whether in brochure or advertisement or in individual conversations, to agree to participate in the Activities;
  2. That the Organization is not responsible or liable for any damage to the Participant’s vehicle, property, or equipment that may occur as a result of the Activities; and
  3. That this Agreement is intended to be as broad and inclusive as is permitted by law of the Province of Ontario and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

Jurisdiction

8. The Parties agree that in the event that they file a lawsuit against the Organization, they agree to do so solely in the Province of Ontario and they further agree that the substantive law of the Province of Ontario will apply without regard to conflict of law rules.


 Acknowledgement

9. The Parties acknowledge that they have read this agreement and understand it, that they have executed this agreement voluntarily, and that this Agreement is to be binding upon themselves, their heirs, their spouses, parents, guardians, next of kin, executors, administrators and legal or personal representatives.

 


RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

3. Curling Canada, CurlON, Huntsville Curling Club and their respective Directors, Officers, committee members, members, employees, coaches, volunteers, officials, participants, agents, sponsors, owners/operators of the facilities in which the Activities take place, and representatives (collectively the “Organization”) are not responsible for any injury, personal injury, damage, property damage, expense, loss of income or loss of any kind suffered by a Participant during, or as a result of, the Activities, caused in any manner whatsoever including, but not limited to, the negligence of the Organization.

  11. Negligence: My negligence and negligence of other persons, including NEGLIGENCE ON the PART OF THE ORGANIZATION, may increase the risk of damage, loss, personal injury or death. I understand that the Organization may fail to safeguard or protect me from the risks, dangers and hazards of curling programs, some of which are referred to

6. In consideration of the Organization allowing me to participate in the Activities, I agree:

  1. That when I practice or train in my own space, I am responsible for my surroundings and the location and equipment that I select;
  2. That my mental and physical condition is appropriate to participate in the Activities and I assume all risks related to my mental and physical condition;
  3. To comply with the rules and regulations for participation in the Activities;
  4. To comply with the rules of the facility or equipment;
  5. That if I observe an unusual significant hazard or risk, I will remove myself from participation and bring my observations to a representative of the Organization immediately;
  6. The risks associated with the Activities are increased when I am impaired and I will not to participate if impaired in any way;
  7. That it is my sole responsibility to assess whether any Activities are too difficult for me. By commencing an Activity, I acknowledge and accept the suitability and conditions of the Activity;
  8. That I am responsible for my choice of safety or protective equipment and the secure fitting of that equipment;
  9. Covid-19: that COVID-19 is contagious in nature and I may be exposed to, or infected by, COVID-19 and such exposure may result in personal injury, illness, permanent disability, or death.
  10. That I should not particpate in any club events I am not feeling well or have Flu like symptoms

Release of Liability and Disclaimer

7. In consideration of the Organization allowing me to participate, I agree:

  1. That the sole responsibility for my safety remains with me;
  2. To ASSUME all risks arising out of, associated with or related to my participation;
  3. That I am not relying on any oral or written statements made by the Organization or its agents, whether in a brochure or advertisement or in individual conversations, to agree to participate in the Activities;
  4. To WAIVE any and all claims that I may have now or in the future against the Organization;
  5. To freely ACCEPT AND FULLY ASSUME all such risks and possibility of personal injury, death, property damage, expense and related loss, including loss of income, resulting from my participation in the Activities;
  6. To FOREVER RELEASE and INDEMNIFY the Organization from any and all liability for any and all claims, demands, actions, damages (including direct, indirect, special and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the “Claims”) which I have or may have in the future, that might arise out of, result from, or relate to my participation in the Activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the Organization;
  7. To FOREVER RELEASE AND INDEMNIFY the Organization from any action related to my becoming exposed to or infected by COVID-19 as a result of, or from, any action, omission or negligence of myself or others, including but not limited to the Organization;
  8. That the Organization is not responsible or liable for any damage to my vehicle, property, or equipment that may occur as a result of the Activities;
  9. That negligence includes failure on the part of the Organization to take reasonable steps to safeguard or protect me from the risks, dangers and hazards associated with the Activities; and
  10. This release, waiver and indemnity is intended to be as broad and inclusive as is permitted by law of the Province of Ontario and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

Jurisdiction

8. I agree that in the event that I file a lawsuit against the Organization, I will do so solely in the Province of Ontario and further agree that the substantive law of the Province of Ontario will apply without regard to conflict of law rules.


 Acknowledgement

9. I acknowledge that I have read and understand this agreement, that I have executed this agreement voluntarily, and that this agreement is to be binding upon myself, my heirs, spouse, children, parents, guardians, next of kin, executors, administrators and legal or personal representatives. I further acknowledge by signing this agreement I have waived my right to maintain a lawsuit against the Organization on the basis of any claims from which I have released herein.

About the Sport

Curling has a long and rich history. While its origins are lost in the mists of time, Scottish curlers already were playing the game by the beginning of the 16th century on frozen ponds and lochs.

Their earliest equipment included stones formed by nature, each one unique. These stones often curved, or “curled,” as they slid down the ice, and the players used besoms or brooms to clear snow and debris from the path of the stones.

Today, curling is a game of strategy, finesse and strength, contested by teams generally comprised of four players. The principle of curling is simple – get your stone closer the center of the target circles, called the “house,” than your opponent. Players of all skill levels can participate and compete even at older ages than most sports allow.

Respect, honor and tradition are core elements of the game. Curlers are close knit and you can rely on a warm welcome in curling clubs throughout the world. Camaraderie among players is inherent in the sport and tradition calls for both teams to sit together after a game, discussing what was and what might have been.

Curling Etiquette

 

Start with a handshake. At the beginning of the game, greet the members of the opposing team with a handshake, tell them your name, and wish them “Good Curling”.

Finish with a handshake. When the game is over, offer each of the players a hearty handshake and move off the ice. The winning curlers traditionally offer their counterparts some refreshments.

Keep the ice clean. Change your shoes. Sand, grit and dirt are the ice’s worst enemy. The shoes you wear should only be used for curling. Keep them clean.

Compliment good shots, no matter which team makes them. Respect your opponent.

Be ready. Take your position in the hack as soon as your opponent has delivered his/her stone. Keep the game moving; delays detract from the sport.

Be prepared to sweep as soon as your teammate releases the rock.

After delivering your stone, move to the side of the sheet between the “hog “ lines, unless you are the skip. Leads and seconds are not permitted in “house” or “rings”, except when sweeping or to remove the stones after the count has been determined by the vices.

Be courteous. Don’t distract your opponent in the hack. Sweepers should stay on the sidelines between the hog lines when not sweeping.

Place your skip’s rock in front of the hack to help speed up the game.

All games on the ice should run approximately the same time. Therefore, if your game is an end or two behind all other games you should pick up the pace. Each player should be ready to deliver their rock when their skip puts down the broom.
